ALEGAL CONDITIONS MEET ME THERE B.V.

Algemeen

1. Meet Me There B.V. ® is located at Herengracht 286, 1016BX in Amsterdam. Chamber of Commerce number 88323374, email address help@meet-me-there.com ("Meet Me There" or "we").
2. Meet Me There sells apparel, jewelry and accessories (the "Products") through its webshop www.meet-me-there.nl (or any other website we operate, collectively the "Website") and through physical stores.
3. These terms and conditions (including all documents referenced herein and any other special terms and conditions confirmed by us in writing, together the "Terms and Conditions") apply to all Meet Me There offers and all agreements between Meet Me There and the buyer ("Buyer" or "you").
4. Please read these Terms and Conditions carefully before placing an order for Products on the Website. By placing an order, you automatically agree to and are bound by these Terms and Conditions. If you have any questions, please contact our Customer Service Department at help@meet-me-there.com before placing an order.

Bestellingen

1. All that Meet Me There offers on the Website or in its stores is without obligation, and Meet Me There may change or withdraw the offer at any time.
2. An agreement is established as soon as Meet Me There has confirmed your order in writing (by e-mail). If you have not received a confirmation within 24 hours of placing your order, please contact our Customer Service.
3. Meet Me There may cancel a confirmed order before it ships, for example, if it cannot obtain authorization for payment, if Meet Me There is owed money by you, if the price is incorrect (in which case you can still order the Product at the correct price), if shipping restrictions apply to a particular Product, if the Product ordered is out of stock or does not meet our quality standards and is withdrawn. Meet Me There will notify you by email. If Meet Me There is unable to contact you, the order will be automatically cancelled.
4. Meet Me There is not obliged to sell the Products at the price offered if Buyer should understand that such price is incorrect or contains an obvious clerical error.
5. If Products are no longer available, whether or not after we confirm your order, we will let you know. You may choose to order another Product from our Website or cancel the order. Any payments made will be refunded upon cancellation.
6. By placing an order, you confirm that the information you have provided is complete and correct; and that you are 16 years of age or older or otherwise have permission from your parent/guardian.
7. Should the Buyer accidentally receive more Products than were ordered, the Buyer will notify Meet Me There by email and return the extra Products to it at Meet Me There's expense.

Pricing and payment

1. All prices are in Euros and include 21% VAT.
2. Payment is made through the payment process on the Website. Klarna collects the payment from Buyer. If Buyer is late in paying Klarna, any additional costs incurred by Klarna will be borne by Buyer. If Buyer returns a Product to Meet Me There, she must first pay the Product to Klarna and after acceptance of the returned Product by Meet Me There, the amount paid will be refunded.
3. To use Klarna you must be at least 18 years old. If Buyer is under 18, he/she must have permission from their parents or guardian.
4. All credit and debit card holders are subject to validity checks and authorization by the card issuer. If the card issuer denies payment, Meet Me There may refuse your order.
5. Eventual shipping costs are listed on the Website and are the responsibility of Buyer.

Delivery, defects and liability

1. Meet Me There will deliver the Products to the shipping or delivery address you provide when placing your order. The Products will be deemed delivered when accepted by or on behalf of you at the delivery address. If, despite our reasonable efforts, we are unable to deliver the Products to you and we are unable to contact you, we will cancel the order.
2. Products that you pick up at a Meet Me There store are deemed to have been delivered at the time you pick them up there.
3. We aim to deliver Products within 3 - 5 business days of order acceptance. Delivery times are estimates and cannot be guaranteed. Meet Me There may also deliver orders in installments.
4. When signed for receipt of an order, it means that the Product has been delivered to Buyer. Should the Buyer nevertheless not have received the Product, the burden of proof of this lies with the Buyer.
5. We are required by law to deliver the Products in accordance with the agreement. You must check the Products for defects as soon as possible after delivery and inform us of any defects in the Products, preferably within seven (7) days after delivery, so that we can, if necessary, make a claim against the carrier. You must notify us as soon as possible but in any event within thirty (30) days after you receive the Product if the Product is defective and send us pictures of the defects. Defective Products may be returned as described in Article 5.
6. We do our best to display the Products as accurately as possible on the Website. However, we cannot guarantee that the images of the Products are an accurate representation of the actual Products, due in part to technical differences in monitors or displays that you use. All specifications, drawings and data on sizes and dimensions are approximations only.
7. Meet Me There's liability is limited to the obligations and product liability set forth in these Terms and Conditions. Any other liability of Meet Me There is expressly excluded, unless the damages result from intent or gross negligence of Meet Me There.

Cancellation and Return Policy

1. You may return Products ordered through the Website within thirty (30) days of receipt, regardless of the reason. To do so, you must request a return form via the Website and return the Products to us by post within fourteen (14) days of the return request at your own expense and responsibility. Online orders cannot be returned in-store.
2. During this thirty (30) day period, you will handle the Product with care and only unpack and possibly try on the Product to the extent necessary to determine whether you wish to keep it. If you wish to return a Product, it must be in its original packaging, with the tags and all related materials. Also, the Product must be unworn and in its original condition. If we receive the Product from you in damaged condition, you will be liable for the damage to the Product and we will not refund you for the returned Product. If your order included a free product/gift, you must return it with the Product to be returned.
3. We are not responsible and/or liable for Products that you return to us by mistake or incorrectly. These Products will not be stored and will not be returned to you.
4. After we receive your return request, we will refund the purchase price and initial delivery charges (if any) as soon as possible, but in any event within fourteen (14) days.
5. Our return policy on the Website allows you to purchase a shipping label for the return. Buyer is solely responsible for the return and bears the risk for the Product until it is delivered back to Meet Me There. If the return shipment does not arrive at Meet Me There for any reason, Buyer will have to deal with the shipper himself.

Overmacht

1. Meet Me There is not liable for any failure or delay in performance due to force majeure. Force majeure means any circumstance beyond Meet Me There's control, such as, for example, strikes, lockouts or industrial disputes or disruptions, civil disturbances, acts of third parties, wars, riots, blockades, lightning strikes, fires, storms, flames, explosions, epidemics and pandemics and related regulations or governmental measures, inability to obtain or maintain necessary consents or permits, and compliance with any law, governmental measure, regulation or directive, whether or not later deemed invalid.
2. In the event of force majeure, Meet Me There will let you know as soon as reasonably possible. Both Meet Me There and you can dissolve the agreement if the force majeure situation lasts longer than 21 (twenty-one) days. Meet Me There will then refund all payments already made for Products not yet delivered.

Account, personal data and privacy

1. Placing an order for our Products may require you to create an account with Meet Me There. In order to open an account, you must provide certain personal information. You are responsible for the security and proper use of your password for your account with Meet Me There. You must also keep this password confidential. If you believe that your account is being abused, please contact our Customer Service immediately.
2. Meet Me There will process your data in accordance with its Privacy Policy. Please read the Privacy Policy carefully. By placing an order or using the Website, you consent to the storage and processing of your data and confirm that the data you provide is correct and complete.
3. By accepting these Terms you give us permission to send our newsletter and offers to you via email. You can always unsubscribe from our offers and our newsletter by clicking the link in the relevant email. Meet Me There may also on its own initiative stop sending offers or newsletters to you at any time.

Intellectual Property Rights

1. All intellectual property rights in the Website, its content (including text, design, layout, graphics and videos), Meet Me There's Products, trademarks and trade names belong to Meet Me There.
2. You may use the Website and the information provided on it for your own personal use (including printing and storing (digitally) for later reference). Any other use (such as copying, redistributing or storing all or part of the content to another website, framing, hyper- or deeplinking to another website) is not permitted without our express written permission.

Beëindiging

Both Meet Me There and you can terminate the agreement (which includes rescission) if:

1. a moratorium or bankruptcy is filed with respect to the other party;
2. suspension of payments or bankruptcy has been granted to the other party;
3. the Natural Persons Debt Rescheduling Act applies to you; or
4. the other party is in breach of its obligations under the agreement and has not remedied that breach within 14 (fourteen) days after being notified of it in writing.

Diversen

1. Meet Me There may change these Terms at any time. By placing an order you agree that the latest version of these Terms apply to your order.
2. Any deviation from the terms of the contract (including these Terms) must be in writing and signed by both parties.
3. References to the term "in writing" shall include e-mail unless otherwise specified.
4. If any provision of these Terms is invalid or unenforceable, that provision shall be superseded by a valid provision and the remaining provisions of these Terms shall remain in effect.
5. The failure to enforce any section of these Terms and Conditions does not constitute a waiver, a waiver must always be express and in writing.
6. Any (general) terms and conditions of you and/or a third party are expressly rejected and do not apply to the agreement between Meet Me There and you.

Applicable law, competent court

1. Dutch law applies to these Conditions, all agreements concluded between Meet Me There and Buyer and all disputes related to them. The conflict rules of Dutch private international law and the applicability of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention of 11 April 1980) are expressly excluded.
2. If resident in the EU, the Court of Amsterdam (the Netherlands) shall have exclusive jurisdiction over all disputes arising out of, or relating to, these Terms and Conditions and our agreement(s). If a Consumer Buyer wishes to submit the dispute to any other competent Dutch court, such Consumer Buyer shall notify Meet Me There in writing within one (1) month after Meet Me There has notified the Consumer Buyer that it wishes to invoke this article, failing which the competent court of Amsterdam, The Netherlands shall have exclusive jurisdiction.
3. If you reside outside the EU, all disputes arising from, or related to, the Terms or any agreements entered into between Meet Me There and you shall be finally decided by arbitration in accordance with the Arbitration Rules of the Netherlands Arbitration Institute. The arbitral tribunal consists of one arbitrator. The place of arbitration is Amsterdam, the Netherlands. The language of the arbitral proceedings will be Dutch, unless you prefer English. The dispute will be settled under Dutch law. This clause does not limit Meet Me There's right to initiate proceedings against you in any other territory, nor does it prevent Meet Me There from applying for interim injunctive relief before the competent court in Amsterdam, the Netherlands.
